TN Mexican and Canadian Workers
The TN visa, or Treaty NAFTA visa, is a nonimmigrant visa category that allows citizens of Canada and Mexico to work in the United States in certain professional occupations. It is based on the North American Free Trade Agreement (NAFTA), which has since been replaced by the United States-Mexico-Canada Agreement (USMCA). The TN visa is specifically designed to facilitate the temporary employment of professionals from Canada and Mexico in the United States. Francis Law excels in assisting individuals with the TN visa application process, utilizing their extensive expertise and knowledge to smoothly guide professionals from Canada and Mexico through the intricacies of obtaining authorization to work in the United States.
Key Features
Eligible Occupations
TN visas are available for individuals who work in certain professional fields, such as science, engineering, computer science, medicine, education, and more. The specific occupation must be listed in the NAFTA Professionals (Appendix 1603.D.1) list.
Citizenship Requirement
To qualify for a TN visa, you must be a citizen of Canada or Mexico.
Job Offer
You must have a job offer from a U.S. employer in a position that requires a NAFTA professional.
Qualifications
You must meet the educational and licensing requirements for the specific profession. This typically means having at least a bachelor's degree or relevant credentials in the field.
Employer Support
Your U.S. employer plays a crucial role in the TN visa process. They must provide a job offer, submit a letter of support, and may must complete to complete certain paperwork.
Period of Stay
TN visa holders can initially stay in the U.S. for up to 3-year increments, with the possibility of extensions in increments of one year. It's important to note that TN status is meant for temporary employment and does not lead to permanent residency (a green card).
Family Members
Spouses and unmarried children under 21 of TN visa holders can apply for TD (Treaty Dependent) visas to accompany the TN visa holder to the U.S. While they can stay in the U.S., they are not authorized to work.
Eligibility Criteria
In contrast to Mexico, Canadian nationals can typically enter the country as nonimmigrants without a visa. This broad exemption from needing a visa is reflected in the nonimmigrant categorization known as TN. Proof is required to establish whether a citizen of Canada or Mexico is a professional in a recognized field determined by NAFTA.
